JOYNER to RENASANT BANK, AS SUCCESSOR BY COPORATE MERGER WITH HERITAGEBANK OF THE SOUTH AS ASIGNEE OF FEDERAL DEPOSIT INSURANCE CORPORATION, AS RECEIVER OF CITIZENS BANK OF EFFINGHAM, SPRINGFIELD GEORGIA dated May 22, 2008 and recorded in Deed Book 1757, Page 423 et seq., and re-recorded in Deed Book 1759 Page 107, et seq., Effingham County Deed Records, as then assigned by Assignment dated February 18, 2011 and recorded in Deed Book 2035, Page 28, et seq., Effingham County Deed Records, modified by that certain Modification of Security Deed, dated July 16, 2019, and recorded in Deed Book 2536, Page 774 et seq., Effingham County Deed Records, said Deed to Secure Debt having originally been given to secure that certain Note in the original principal amount of SEVENTY-EIGHT THOUSAND FOUR HUNDRED NINETY EIGHT and 15/100 DOLLARS ($78,498.15) of even date therewith, as well as all extensions, renewals and modifications thereof, together with any and all other indebtedness, of any type or description, then or thereafter owing by KATHLEEN M. JOYNER to RENASANT BANK, AS SUCCESSOR BY COPORATE MERGER WITH HERITAGEBANK OF THE SOUTH AS ASIGNEE OF FEDERAL DEPOSIT INSURANCE CORPORATION, AS RECEIVER OF CITIZENS BANK OF EFFINGHAM, SPRINGFIELD GEORGIA, there will be sold by the undersigned, at public outcry, to the highest bidder for cash, before the courthouse door at Springfield, Effingham County, Georgia, within the legal hours of sale on the first Tuesday in September 2025, the following described property: ALL that certain tract or parcel of land situate, lying and being in the 12th G.M. District of Effingham County, Georgia, containing Seven and Twenty-Four Hundredths (7.24) acres, more or less, and being known and designated as Parcel 1 as shown on the plat thereof hereinafter referred to. Said parcel of land being bounded on the Northeast by Parcel 2; on the Southeast by lands of Robert R. Parsons; on the Southwest by the Old Dixie Highway known as County Road No. 33 and by lands of Alton Malphus, and on the West by lands of E. A. DeWitt, Jr. Express reference is hereby made to a plat of said lands made by Warren E. Joyner, Sr.'s estate, dated October 3, 2007 and recorded in Deed Book 1681, Page 356. LESS AND EXCEPT, Two and One Half (2.50) acres of said lands conveyed by deed from Kathleen M. Joyner to Nicole J. Tanner dated May 9, 2008 and recorded in said Clerk's Office in Deed Book 1753, Page 284. ALSO, a 2009 Scott Built Heritage Manufactured Home, Serial # SBHGA1200803484AB. The indebtedness secured by the aforementioned Deed to Secure Debt has been and is hereby declared immediately due and payable in full because of the failure of KATHLEEN M. JOYNER to maintain payments upon said indebtedness owing to the RENASANT BANK, AS SUCCESSOR BY COPORATE MERGER WITH HERITAGEBANK OF THE SOUTH AS ASIGNEE OF FEDERAL DEPOSIT INSURANCE CORPORATION, AS RECEIVER OF CITIZENS BANK OF EFFINGHAM, SPRINGFIELD GEORGIA, in accordance with its terms. Said indebtedness remaining in default, this sale shall be made for the purpose of paying such indebtedness, as well as all expenses of this sale, including attorneys' fees. The above-described real property will be sold as the property of KATHLEEN M. JOYNER and will be sold subject to the following items which may affect the title to said property: all zoning and subdivision ordinances and/or regulations; matters which would be disclosed by an accurate survey or an inspection of the property; all real property ad valorem taxes or assessments, which may constitute liens upon said property; all liens which, under applicable law, would take priority over the Deed to Secure Debt described above; and all easements, restrictions, rights-of-way, Deed to Secure Debts or other encumbrances of record which have priority over the referenced Deed to Secure Debt.
